| 释义 | 支撐地役權 An easement for support of a building on the dominant tenement, for example relating to underpinning structures extending into the servient tenement, or a supporting wall or other structure on the servient tenement. Such an easement does not follow from the natural right of support enjoyed by undeveloped land, but must be acquired by grant, reservation or prescription: Dalton v Angus & Co (1881) 6 AC 740. Where an easement for support exists, the owner of the servient tenement must not deliberately withdraw the support, but is not bound properly to maintain any supporting structure, as this is the responsibility of the owner of the dominant tenement.
