An easement implied upon the severance of two tenements or two parts of a tenement, in favour of the reserved tenement or part: for example Wheeldon v Burrows (1879) 12 Ch D 31; St Edmundsbury and Ipswich Diocesan Board of Finance v Clark (No 2) [1973] 3 All ER 902, [1975] 1 All ER 772 (CA). The rule of implied reservation is founded upon the mere necessity of the case and the impossibility of admitting that the contract, according to the true intention of the parties, would be complete without this implication: Tang Tim Fat & Anor v Chan Fok Kei & Ors [1992] 2 HKC 623; [1993] 2 HKLR 373.
