The rule of implied reservation is founded upon the mere necessity of the case and the impossibility of admitting that the contract, according to the true intention of the parties, would be complete without this implication: Tang Tim Fat & Anor v Chan Fok Kei & Ors [1992] 2 HKC 623; [1993] 2 HKLR 373. An easement of this type is not common as it may constitute a derogation from a grant.
