单词 Economic duress
Illegitimate economic pressure in the form of threats to a person’s economic well being, business or trade, with the result that a contract is entered or payments are made. Examples of economic duress include the threat to break an existing contract unless a party agrees to pay more than the agreed consideration: North Ocean Shipping Co Ltd v Hyundai Construction Co Ltd (The Atlantic Baron) [1979] 1 QB 705. In economic duress, the promisor’s apparent consent is treated in law as revocable unless approved either expressly or by implication after the illegitimate pressure has ceased to operate on his or her mind: Universe Tankships Inc of Monrovia v International Transport Workers Federation (The Universe Sentinel) [1982] 2 All ER 67, [1983] 1 AC 366. Economic duress makes a contract voidable. See also Duress; Duress of goods; Duress to the person.
Universe Tankships Inc of Monrovia v International Transport Workers Federation (The Universe Sentinel) [1982] 2 All ER 67, [1983] 1 AC 366。 Duress; Duress of goods; Duress to the person。
