释义 | 藉時效歸益權產生的地役權 By virtue of easement acquired by lost of modern grant under common law principle and the Prescription Act 1832 with modifications, a limited owner in Hong Kong can prescribe against another limited owner for an easement: Kong Sau Ching v Kong Pak Yan & Ors [2004] 1 HKC 119. An owner whose title was not of lawful origin could claim for easement by way of prescription even though an easement could not be acquired by way of implied grant as the owner may have acquired his title by adverse possession and thus he is entitled to an express grant of easement: Chung Yeung Hung & Ors v Law Man Nga & Anor (t/a Constant Rich Investment Co) [1997] 2 HKC 406. 憑藉在普通法及1832年時效歸益權法令及修訂下喪失現代授予而獲得的地役權,香港的有限擁有人可針對某地役權的另一有限擁有人作出限定:Kong Sau Ching v Kong Pak Yan & Ors [2004] 1 HKC 119。其擁有權並非從合法來源所得的擁有人,可藉時效歸益的方式申索地役權,但不可憑藉隱含授予的方式獲得地役權,因為有關的擁有人可能已憑藉逆權管有的方式獲得其所有權,因而他/她有權獲得明示地役權授予:Chung Yeung Hung & Ors v Law Man Nga & Anor (t/a Constant Rich Investment Co) [1997] 2 HKC 406。 |
