Provisional recognition by a state that a government which has come to power by unconstitutional means has effective control over a given territory. De facto recognition is given when there is some doubt as to the capacity of the new government to exercise authoritative control or to represent the state effectively in the international arena. Although such a government is denied diplomatic recognition, its authority is recognised as collective within the territory it controls. Thus the common law courts would not inquire into the validity of the acts of such a government on its own territory. Accordingly, the acts done by the former, yet de jure government as regards the part of the territory of the country it formerly controlled, but now under the control of the de facto government, are to be regarded as a mere nullity in that area: Civil Air Transport Inc v Chennault & Anor [1946-1972] HKC 18, (1950) 34 HKLR 386 (CA).
