Progress payment |
1. A payment made at a precise point in the carrying out of a contract at which the contractual goals have been met. Thus, payments are made sequentially over the life of the contract until completion. 2. In relation to a building contract, payment by instalment of part of the agreed contract price, usually made upon presentation of a process certificate given by the contract administrator. A process payment is an interim payment on account of the contract sum. The entitlement to progress payments is the quid pro quo for the obligation to continue working: LU Simon Builders Pty Ltd v H D Fowles [1992] 2 VR 189. In issuing a progress certificate, the contract administrator is required to determine the value of the work performed; this valuation forms the basis of the certificate. Also known as ‘interim payment’ in England. See also Building contract; Progress certificate. 1. |
