| 释义 | 船舶抵押借款擔保契據 A form of contract of bottomry under which the master of a vessel states the reason for taking out the contract and pledges the master, the ship, the freight and sometimes the cargo, in exchange for an undertaking to repay the principal and interest on the safe arrival of the ship at the destination. It is used as a form of guarantee for the ship or cargo lodged by the master to obtain the necessary funds and continue with the scheduled voyage. Where the competing interests are the bottomry bond and necessaries in the nature of wages, the latter has a higher priority than the former: The William F Stafford (1860) Lush 69; The St Lawrence (1880) 5 PD 250; The Sparti [2000] 3 HKC 323, 3 HKLRD 561.
