释义 | 非正審法律程序 Proceedings, normally relating to matters of practice and procedure, in which the substantive rights of the parties to the matter are not finally determined. Proceedings which deal with the rights of the parties in the interval between the commencement of the proceedings and their final determination. For example, proceedings to set aside the service of originating process outside the jurisdiction or to obtain an injunction preserving a party’s rights pending final determination at trial (Shepherd Homes Ltd v Sandham [1970] 3 All ER 402, [1971] Ch 340). Interlocutory proceedings are in most cases brought either by motion or by summons: The Rules of the High Court (Cap 4A) O 13, O 75. Their function is to enable the court to grant such interim relief or remedy as may be just or convenient: Day v Brownrigg (1878) 10 Ch D 294 (CA).
