| 释义 | 危險駕駛 Driving a motor vehicle on a road dangerously: Road Traffic Ordinance (Cap 374) s 37(1). A person who causes the death of another person by driving a motor vehicle on a road dangerously is guilty of an offence: s 36(1). A person is regarded as driving dangerously if the way he drives falls far below what would be expected of a competent and careful driver; or it would be obvious to such competent driver that the manner of driving, or driving the motor vehicle concerned in its current state would be dangerous: s 37(4). The word ‘dangerous’ refers to danger either of injury to any person or of serious damage to property: Road Traffic Ordinance (Cap 374) s 37(6); R v Yeung Chak Por [1984] 1 HKC 67 (HC); A-G v Kwan Tak Fu [1994] HKC 361 (HC).
