释义 | 國際商事仲裁 The procedure adopted by the transnational actors as a binding resolution of the merits of business disputes. The growth of international commercial arbitration largely took place after the World War II as a result of the explosive growth of international trade and investment and it was until mid-1980’s, arbitration was considered to be a normal alternative to settle international dispute of commercial nature. The UNCITRAL Model Law on International Commercial Arbitration represents internationally agreed principles of best practice in international arbitration. The Model Law has been adopted in Hong Kong with minimal modification: Arbitration Ordinance (Cap 341) ss 2(4), 34C(2).
