A cost order made prior to the main hearing of a matter where one party may be unsuccessful in respect of a motion or an interlocutory application, or where a party has failed to comply with directions or requirements set by the Court. In practice, the customary costs order made in interlocutory proceedings is usually that costs should go to a party ‘in any event’. In exceptional circumstances, ‘plaintiff’s costs’ or ‘defendant’s costs’ will be used such that the party concerned will be entitled to obtain immediate taxation. In the absence of the words ‘in any event’, the court is presumed to have considered circumstances and intended that the party concerned will be entitled to have immediate recovery of costs: Aktieselskabet Dansk Skibsfinansiering v Wheelock Marden & Co Ltd [1994] 1 HKC 607.
