The loading of a ship, aircraft, road, or rail vehicle with goods of a mass in excess of that which the ship, aircraft or vehicle is permitted by law to carry. Overloading of a ship occurs when the load line is submerged on each side when the ship is in saltwater. Overloading renders a ship unseaworthy: Weir v Aberdeen (1819) 2 B & Ald 320; Kopitoff v Wilson & Ors (1876) 1 QBD 377. It is an offence for a vehicle so loaded with goods that its gross weight exceeds the permitted gross weight assigned to the vehicle under the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap 374E): R v Tsang Chu Lun & Anor [1994] 1 HKC 769. An overloaded car, although it could be driven safely, was unsafe for ordinary use and was, therefore, unroadworthy, which is one of the general exceptions in an insurance policy: Clarke v National Insurance and Guarantee Corp Ltd [1963] 2 Lloyd’s Rep. 35.
