释义 | 安全 Free from danger. In tort, the employer has a non-delegable common law duty to provide a safe place of work for his employees and maintain such place in a state of reasonable safety: Hudson v Ridge Manufacturing Co Ltd [1957] 2 QB 348, 2 All ER 229. The employer is under a duty to ensure that the common practice followed is safe: Wilsons & Clyde Coal Co Ltd v English [1938] AC 57, [1937] 3 All ER 628 (HL). In many instances the courts are content to hold that an implied duty is owed by an employer for the safety of an employee without specifying whether it arises under the contract or more generally as part of a wider tortious liability: Lam Fong (Administrator of the Estate of Yip Ka, dec’d) v Ocean United Barge and Engineering Co Ltd (CACV 168/86, unreported).
