A term in a bill of lading specifying that the master and carrier are unaware of the nature or quantity of the contents of a package, crate or container and are relying on the description furnished by the shipper. After receiving the cargo, the carrier will issue a bill of lading to the shipper on the basis of the cargo details furnished by the shipper, provided that the carrier does not have any grounds for suspecting the accuracy of the cargo details or has had reasonable means of checking the cargo: Hague Visby Rules art III r 3(b). The phrase ‘said to contain’ indicates that the details, such as weight, number and quantity etc, of the cargo are furnished by the shipper, without dissent from the carrier. This is prima facie evidence of the cargo carried on board. ‘Said to contain’ is not the same as the qualifier ‘weight, number and quantity unknown’. Where the bill is so qualified, it does not even constitute prima facie evidence that the goods detailed by the shipper have been shipped: The River Gurara [1998] 1 Lloyd’s Rep 225.
