| 释义 | 司法錯誤 1.In administrative law, the purported exercise by a tribunal or court of jurisdiction in excess of that which has been conferred upon it, that is, ultra vires or the failure to exercise its proper jurisdiction which is a ground of judicial review under the head of illegality. If the court or tribunal makes a wrong finding on a matter on which its jurisdiction depends, he makes as jurisdictional error; and certiorari will lie to quash his decision: Anisminic Ltd v Foreign Compensation Commission [1969] 2 AC 147. 2. In private law, the court also committed a jurisdictional error when it purported to act beyond the power conferred by a relevant ordinance. Thus a contested winding-up order granted by a Master shall be set aside by way of appeal since a master’s jurisdiction on companies winding-up extended only to unopposed petition under the Companies Ordinance (Cap 32) s 180A(1): Hong Kong Property Services (Agency) Ltd v Pioneer Venture International Ltd [1999] 1 HKLRD D4 (CA).
