释义 | 司法管轄權條款 A clause in a contract providing for the settlement of any dispute between the parties arising out of the contract to take place in a court of law of a particular jurisdiction. It does not apply to arbitration or any other form of non-crucial dispute resolution. Where the transaction under the contract is potentially subject to the jurisdiction of two or more countries, the clause specifies the country that has jurisdiction over the contract: Trafalgar House Construction (Asia) Ltd & Anor v The Owners and/or Demise Charterers of MV (Thor Scan) [1999] 2 HKLRD 136 (CA); T & K Electronics Ltd v Tai Ping Insurance Co Ltd [1997] 3 HKC 330, [1998] 1 HKLRD 172 (CFI); Re The Makhutai [1996] 2 HKC 1, 2 HKLR 199 (PC).
