A petition for judicial separation may be presented to the court by either party to the marriage on the ground that any such fact as may prove irretrievable breakdown on a petition for divorce exists. The court, however, will not be concerned in relation to whether the marriage has broken down irretrievably, and, if it is satisfied on the evidence of any of the alleged facts, it must, subject to the provisions relating to the arrangements for the children and the family, grant a decree of judicial separation. Once a decree of judicial separation is granted, it is no longer obligatory for the petitioner to cohabit with the respondent. A person would not be prevented from making a petition or application for divorce by reason only that he or she was granted a decree of judicial separation: Matrimonial Causes Ordinance (Cap 179) ss 13, 24; Halsbury’s Laws of Hong Kong, Vol 12, Family Law [180.180]-[180.183]. 婚姻的任何一方均以婚姻已破裂至無可挽救為理由可向法院提出裁判分居呈請,猶如其適用於離婚呈請一樣。法院無須考慮婚姻是否已破裂至無可挽救,如法院信納任何指稱為事實的證據,根據有關對子女及家庭的安排的條文,法院必須批出裁判分居判令。凡法院批出裁判分居判令,呈請人即再無須與答辯人同居。任何人不得僅因呈請人或申請人或答辯人曾獲批出裁判分居判令而被阻止提出離婚呈請或離婚申請:《婚姻訴訟條例》(第179章)第13、24條;Halsbury’s Laws of Hong Kong, 第12冊,家庭法,第[180.180]-[180.183]段。另見 Alimony pendente lite; Dissolution; Separation。
