释义 | 平等機會委員會 A body corporate established under the Sex Discrimination Ordinance (Cap 480) which (a) works towards the elimination of discrimination; (b) promotes equality of opportunity between men and women generally; (c) works towards the elimination of sexual harassment; (d) in the case of any act alleged to be unlawful by virtue of the Sex Discrimination Ordinance, encourages persons who are concerned with the matter to which the act relates to effect a settlement of the matter by conciliation; (e) keeps under review the working of the Sex Discrimination Ordinance and, when it is so required by the Chief Executive or otherwise thinks it necessary, draws up and submits to the Chief Executive proposals for amending the Sex Discrimination Ordinance; and (f) performs such other functions as are imposed on it under the Sex Discrimination Ordinance or any other enactment: Sex Discrimination Ordinance (Cap 480) s 64(1). The Commission shall have perpetual succession and a common seal and shall be capable of suing and being sued. The Commission may conduct a formal investigation for any purpose connected with the carrying out of any of its statutory functions: s 70. The Commission shall prepare a report of its findings in any formal investigation conducted by it: s 73. The Commission helps a person who considers he may have been discriminated against or sexually harassed by obtaining information: s 83. Where a complaint is lodged, it will conduct an investigation, and endeavour to effect a settlement of the matter by conciliation: s 84. If there has not been a settlement, then the Commission may assist the person by giving advice, arranging for the giving of advice by a solicitor or counsel, arranging for representation in any proceedings: s 85. The Commission also derives powers from the Disability Discrimination Ordinance (Cap 487) and Family Status Discrimination Ordinance (Cap 527), and it has similar powers under those Ordinances.
