Safety is a question of fact (The "Lottinge" (Owners) v British Transport Commission [1958] 1 Lloyd’s Rep 255), but the criteria in determining the safety of a port is a matter of law (The Polyglory [1977] 2 Lloyd’s Rep 353), for example, the adequacy of the weather forecasting system, the availability of pilots and tugs, adequacy of searoom to manoeuvre (The Khian Sea [1979] 1 Lloyd’s Rep 545). The safety of a port refers to the particular ship in question: Brostrom v Dreyfus (1932) 38 Com Cas 79. Factors governing whether a port is safe include the physical features of the port (Transoceanic Petroleum Carriers v Cook Industries Inc, The Mary Lou [1981] 2 Lloyd’s Rep 272), and the size and draught of the ship (Leeds Shipping Co Ltd v Société FranÇaise Bunge, supra), its mode of access and the dangers of the particular voyage. A safe port term in a charterparty places the responsibility on the party with cargo interests to require the ship to sail to a safe port taking into account the nature of the cargo to be discharged.
