释义 | 減損/減免 A subsequent act which limits or partially repeals the rights which initially granted. It involves the act of taking away part of the right which previously existed: Harmer v Jumbil (Nigeria) Tin Areas Ltd [1921] 1 Ch 200. When a statute expressly stated that it was not being in derogation then it implies that the statute can be exercised in addition to that right: Yelland v Powell Duffryn Associated Collieries Ltd (No 2) [1941] 1 KB 519. Derogation is in contrast with subrogation which is the entire repeal of an existing right.
