A loss in value of the land, to the detriment of the remainderman, caused when a life tenant in possession of the land fails to keep the property in repair. Permissive waste implies an omission through which damage results to the premises as for example, where houses are allowed to fall into decay: Herne v Bembow (1813) 4 Taunt 764. The life tenant is not liable to the remainderman for permissive waste unless the instrument creating life estate imposes an obligation to repair upon the life tenant: Re Cartwright (1889) 41 Ch D 532. The obligation imposed by law not to commit permissive waste is overlapped with the implied obligation of a tenant to use premises in a tenant-like manner: Kamsham Holdings Ltd v Chan Tung Man [1999] 3 HKC 414, 3 HKLRD 24. A tenant for years is liable for permissive waste (Davies v Davies (1888) 38 Ch D 499), whereas a weekly tenant and a tenant at will (Harnett v Maitland (1847) 16 M & W 257) is not liable.
