释义 | 周期租約 A tenancy by the period and does not expire without notice at the end of the period or at the end of each period, there being not a reletting at the beginning of every week or period but a springing interest which arises and which is determined only by proper notice to quit, and should, subject to the statutory requirements, be equal to the length of the period: Mellows v Low [1923] 1 KB 522. For example, a week’s notice for weekly tenancy, a month’s notice for monthly tenancy, and a quarter’s notice for a quarterly tenancy: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.182], [235.183]. Periodic tenancy arises either by express agreement or presumption of law: Ford Chung v Ho Wai Man [1959] HKLR 12. A holding over with the landlord’s consent, which prima facie gives rise to a tenancy at will, may be converted by the parties by their conducts or agreement into a periodic tenancy, ie a tenant holding over after a term of years at a monthly rent acquires a monthly tenancy: Tong Mo Chiu v Kai Sun Iron Factory [1964] HKLR 192.
