释义 | 易毀消的貨品 Goods, especially food, which go bad quickly. Since such goods will lose their value if not put to their intended use within a short period of time, the carrier will make special arrangements and give priority to the carriage of these goods, so that they can reach their intended destination with the least possible delay. Pre-loading inspection will be carried out to determine whether the goods are fit for the voyage. In legal proceedings, a party may apply to the court for the sale of goods which are of a perishable nature or likely to deteriorate if kept: Rules of High Court (Cap 4A) O 29 r 4 (1). An injunction restraining the relevant parties from dealing with perishable goods is unsatisfactory. Perishable goods should be sold and the proceeds paid into court, pending resolution of the disputes between the parties: United Fruit Co v Frederick Leyland & Co Ltd and Roberts, Brining & Co Ltd [1930] 38 Ll L Rep 3. Perishable goods under seizure pursuant to statutory power may be destroyed, or sold and the proceeds retained by the relevant authorities: Dutiable Commodities Ordinance (Cap 109) s 52(1)(b); Weights and Measures Ordinance (Cap 68) s 27.
