释义 | 衍生租契 A lease where the title granted or its terms depend for efficacy upon, or originate in, those of another lease: Brumfit v Morton (1857) 3 Jur NS 1198. It can be assume that the term of such lease is consistent with the head lease unless expressly provides otherwise: Waring v Hoggart (1824) Ry & M 39, 171 ER 935. However, the duration of the derivative lease must be shorter than the head lease: Malcolm Merry, Hong Kong Tenancy Law (3rd Ed, Butterworths Asia, 1997) p 118. Also known as ‘under lease’ or ‘sublease’.
