释义 | 半事實 Information or a statement which is ultimately rendered incorrect as it does not set out the whole of the relevant information. A half-truth is correct to an extent but ultimately conveys a misrepresentation as not all the facts are apparent. Conduct may be misleading or deceptive where the overall impression conveyed is not correct. A half-truth may be a misrepresentation: Royal Bank of Scotland v Greenshields (1914) SC 259. 指因沒有列明全部有關資料而最終被視為不正確的資料或陳述。半事實在某程度上是正確的,但最終因所有事實並非可都清楚明白而轉化成失實陳述。如某行為表達的總印象不正確,則可屬誤導性或具欺騙性。半事實可屬失實陳述:Royal Bank of Scotland v Greenshields (1914) SC 259。 |
