释义 | 騷擾 The act of annoying or obstructing another person by interference, threat, or emotional or physical violence. Engaging in unwelcome conduct (which may include an oral or written statement) on account of another person’s disability, or on account of the disability of an associate of another person, in circumstances in which a reasonable person, having regard to all the circumstances, would have anticipated that that other person would be offended, humiliated or intimidated by that conduct: Disability Discrimination Ordinance (Cap 487) s 2(6). It is unlawful for any person, in relation to employment provided by such a person at an establishment in Hong Kong, to harass a person with a disability who either seeks to be employed, or is employed, by such a person: s 22(1), (2). Intimidation and threats uttered by a person to another can amount to an harassment if the other to whom the threats are uttered suffers nervous shock or illness therefrom, this assault may be actionable: Janvier v Sweeney & Anor (1919) 2 KB 316 (CA); Wong Kwai Fun v Li Fung [1994] 1 HKC 549 (HC).
