释义 | 謄本 A written record of court proceedings which includes evidence given by the parties and their witnesses, and records and exhibits, including the time at which they were introduced into evidence. It includes the transcript of the official shorthand note and any official typescript of the judge’s manuscript note: The Rules of the High Court (Cap 4A) O 68 r 8A. A transcript of shorthand notes of the proceedings in open court does not involve any such ‘professional knowledge, research and skill’: Lambert v Home [1914] 3 KB 86 (CA). The transcripts of proceedings for appeal purposes must be prepared in either one of the official languages or both official languages as the Court of Appeal may direct: High Court Civil Procedure (Use of Language) Rules (Cap 5C) r 7(2). Submissions are not usually transcribed. Transcripts are placed on the court file. If there is a dispute over the accuracy of some of the contents of the transcript, the errors are corrected on the next day of the hearing or the first date convenient to the court and the parties. If there is a dispute then the parties file affidavits setting out what they purport to be the evidence.
