| 释义 | 文件上的所有權 Ownership of property proven by possession of the indicia of title relevant to the type of property held and, if necessary, proven by registration. The holder of the documentary title of property is entitled to possession of the property. Actual possession is not required for documentary title to be maintained, unless there is prolonged adverse possession, in which case rights to the property can be extinguished. Unless the contrary intention is expressed, a purchaser of land shall be entitled to require from the vendor, as proof of title to that land by producing a good documentary title: Conveyancing and Property Ordinance (Cap 219) s 13. A defective title could be cured by possession only if the vendor proved a good documentary title up to the defect: In Re Atkinson and Horsell’s Contract [1911-13] All ER Rep 893, [1912] 2 Ch 1; Lai Chung Yue & Anor v Chau Shing & Anor [1987] 3 HKC 406, [1988] HKLY 566.
