Lat – not having capacity for fraudulent conduct. There is an irrebuttable presumption that a child under the age of seven is doli incapax, that is, incapable of committing a crime: Juvenile Offenders Ordinance (Cap 226) s 3. The same is presumed in relation to children between the age of seven and 14: C v DPP [1996] 1 AC 1, [1995] All ER 43 (HL). The prosecution must prove that the child knew that what was done was seriously wrong and not merely naughty or mischievous and knew the natural and probable consequences of his act: R v Owen (1830) 4 C & P 236; R v Chan Chi Wah [1967] HKLR 241; C v DPP, supra.
