References to a child (or issue if appropriate) living at the death of any person include the one en ventre sa mère at the death: Intestates’ Estate Ordinance (Cap 73) s 2; Perpetuities and Accumulations Ordinance (Cap 257) s 2; Inheritance (Provision For Family and Dependents) Ordinance (Cap 481) s 2. This term is applicable to contingent gifts, class gifts, class closing rules, the rules of intestacy and the rule against perpetuities; if a child is en ventre sa mère at the end of the perpetuity period or the effective date of the contingent or class gift and later born alive, the perpetuity period may be extended by the period of gestation and the child may be included as a life in being or member of the class.
