| 释义 | 行政上訴 An appeal from a decision of a statutory authority to which the Administrative Appeals Board Ordinance applies: Administrative Appeals Board Ordinance (Cap 442) sch. As to most of the decisions to which that Ordinance applies, see the Schedule to that Ordinance. The Administrative Appeals Board may confirm, vary or reverse the decision that is appealed against or substitute therefor such other decision or make such other order as it may think fit, bearing in mind any statement of policy that the appellant was or could reasonably have been expected to be aware of at the time of the making of the decision. The Administrative Appeals Board may, before an appeal is determined, refer a question of law arising in the appeal to the Court of Appeal for determination by way of case stated. See also Judicial review. 對《行政上訴委員會條例》所列之法定機構的決定提出的上訴：《行政上訴委員會條例》（第442章）附表。該條例適用之大部分決定，見該條例附表。行政上訴委員會應顧及在所作決定時上訴人應知道或理應知道的政策聲明，然後可確認、修訂或推翻所上訴之決定，也可用其他決定取代之，或作出其認為適當的其他命令。就上訴述作決定前，行政上訴委員會可就上訴所涉及的法律觀點，用案件呈述的方交由上訴庭作決定。另見 Judicial review。 |
