释义 | 行政計劃 A scheme will be directed by the courts where the terms of a charitable trust or the instrument of foundation are ambiguous or insufficient, or where no particular objects are defined: Re White v White [1898] 2 Ch 41 (CA). Generally, equity refuses to recognise a trust, other than a charitable trust, unless any benefit granted therein is for ascertainable beneficiaries; hence, if the charitable intent is clear but the mode of carrying out the gift is specified but cannot be executed, the court will carry out the donor’s charitable intent by means of a scheme. This is not the application of the cy-près principle (that is, as near as possible) as the objects to be benefited have been clearly identified by the testator and the court is doing no more than completing the trusts to carry out those objects: Re Robinson, Besant v The German Reich [1931] 2 Ch 122. Hence, a charitable trust will never fail for uncertainty: Mills v Farmer (1815) 1 Mer 55, 19 Ves 482.
