释义 | 轉移的惡意 The common law doctrine that where a person commits a criminal act intending a particular result but which has an outcome which was not intended but is still criminal, the person may be convicted of the latter crime if his act and his intention coincided: R v Mitchell [1983] QB 741, 2 All ER 427, 76 Cr App Rep 293 (CA). The victim, the subject of the transferred malice, need not be a life in being at the time of the act and thus, if the accused attacks a woman who is carrying a foetus and injures the foetus, he is guilty of murder if he had the relevant intent for murder towards the mother and if the foetus becomes a life in being and subsequently dies of the injuries perpetrated by the accused: Kwok Chak Ming (No 2) v R [1963] HKLR 349. The act need not be directed at the victim and it is sufficient that the accused committed an unlawful and dangerous act which killed someone: R v Mitchell [1983] QB 741, [1983] 2 All ER 427 (CA).
