In relation to a building contract, a clause providing for adjustments to the original contract price in consequence of variation in costs, and entitling the contractor to be reimbursed for any increase in the cost of labour or materials or giving the employer the benefit of any decrease in such costs: Blaenau Gwent Borough Council v Lock (Contractor’s Equipment) Ltd (1994) 71 BLR 94, 37 Con LR 121. By inclusion of the rise and fall clause, the proprietor assumes the risk of cost fluctuations in labour and materials. However, a rise and fall clause relating to the cost of labour did not apply to a bonus incentive scheme operated by the contractors: William Sindall Ltd v North West Thames Regional Health Authority [1977] ICR 294, 4 BLR 151 (HL).
