Writing executed by hand. Comparison of a disputed writing with any writing proved to the satisfaction of the court to be genuine shall be permitted to be made by witnesses in any proceedings. Such writings, and the evidence of witnesses respecting the same, may be submitted to the court and to the jury, as evidence of the genuineness or otherwise of the writing in dispute: Evidence Ordinance (Cap 8) s 17; HKSAR v Dong Xiao Ming & Anor [1998] 4 HKC 190 (CA). The proof of handwriting may require either lay or expert evidence, or both, depending upon the point at issue. The standard of proof in criminal cases is the civil standard of balance of probabilities: R v Angeli [1978] 3 All ER 950, 68 Cr App Rep 32 (CA). It is wrong for a jury to be invited to compare handwriting without the assistance of an expert: R v Tilley [1961] 3 All ER 406, 1 WLR 1309. See also Circumstantial evidence.
