| 释义 | 1979年海牙-維斯比規則 The rules relating to contracts of carriage of goods by sea and establishing an international liability regime, defining the rights and liabilities of the owner of such goods, the consignee, and the charterparties or carrier of those goods. The Hague Rules 1979 consist of the Protocol (1979) (SDR Protocol) amending the International Convention for the Unification of Certain Rules of Law relating to Bills of Lading of 25 August 1924 (Hague Rules) as amended by the Protocol of 23 February 1968 (Visby Rules). The Hague Rules 1979 have been given force in the Hong Kong SAR by the Carriage of Goods by Sea Ordinance (Cap 462) with its text stated in the Carriage of Goods by Sea Ordinance (Cap 462) sch. The Bills of Lading and Analogous Shipping Documents Ordinance (Cap 440) makes provision for bills of lading and other shipping documents without prejudice to the application in the Hong Kong SAR of the Hague Rules 1979. The Hague Rules 1979 are not an exclusive code of carriers’ liability. However, the carriers’ duties provided for by the Rules cannot be contracted out except as permitted by the Rules.
