| 释义 | 有意圖的遊蕩 一 A public order offence enabling the apprehension of a person loitering at night on the reasonable belief that the suspect has committed or is about to commit or intends to commit any indictable offence under the Offences Against the Person Ordinance: Offences Against the Person Ordinance (Cap 212): s 56. The prosecution must prove that the loitering appeared to be for purposes which are other than innocent: A-G of Hong Kong v Sham Chuen [1986] HKLR 1043, 1 AC 876 (PC). The intent necessary may be inferred from the conduct of the accused: R v Chiu Man Mo (CACC 118/69, unreported); R v Chung Ping Kai (CACC 119/69, unreported). It is not improper to lay charges of both loitering and going equipped for stealing: Wong Chi Ming v R [1974] HKLR 24; Kwok Yip Shing v R [1974] HKLR 416.
