释义 | Walsh訴Lonsdale之規則 The doctrine that a tenant who holds under an agreement for lease of which specific performance would be decreed, stands in the same position as if the lease had been executed: Walsh v Lonsdale (1882) 21 Ch D 9. Such a lease is an ‘equitable lease’. The rule in Walsh v Lonsdale is also applicable to other interests in land and has been extended to the situation where the landlord lacks legal title but is the equitable owner of the property which he demises. In such a case, any purported lease by him is effective against the tenant from then onwards as an agreement to grant a lease to that tenant: Industrial Properties (Barton Hill) Ltd v Associated Electrical Industries Ltd [1977] QB 580, 2 All ER 293 (CA).
