释义 | 履行/解除 To relieve oneself, or to be relieved, of an obligation. Contract - 1. The extinguishment or release of obligations under a contract. A contract may be discharged in any one of four ways, namely, by performance, by agreement, by one party accepting the other’s breach as repudiation, and by frustration. For example, if a contract has become impossible of performance or been otherwise frustrated, and the parties thereto have for that reason been discharged from the further performance of contract, special provisions shall have effected to the parties: Law Amendment and Reform (Consolidation) Ordinance (Cap 23) ss 16, 17, 18. 2. Used to describe the effects of termination, whether for breach or repudiation, or under the doctrine of frustration. An order made at the conclusion of committal proceedings when the magistrate is not satisfied that there is sufficient evidence to put the defendant upon his trial. An order discharging the defendant is not the same as acquittal and is not a bar to further proceedings against the defendant for the same charge: Magistrate Ordinance (Cap 227) s 85(1). A further prosecution by way of an ex officio indictment was an abuse of process: R v Manchester City Stipendiary Magistrate ex p Snelson (1977) 1 WLR 911, 66 Cr App R 44 (DC). 2. An order made on sentencing where the charge is proved but having regard to the character, antecedent, age, health or mental condition of the offender or to the trivial nature of the offence, the offender is released conditionally or absolutely: Magistrates Ordinance (Cap 227) s 36; Criminal Procedure Ordinance (Cap 221) ss 107, 108.
