释义 | 藉履行解除 Parties to a contract normally discharge their liabilities under the contract by performance of their promises which are the contractual obligations. The performance has to be precise in accordance with the promises made: Cutter v Powell (1795) 6 TR 320, 101 ER 573. However, the courts do ignore trivial deviations (de minimus non curat): Shipton, Anderson & Co v Weil Brothers & Co [1912] 1 KB 574. In case of joint liability, the performance of one discharges the obligations of others: Cheng Hang Chu & Ors v China Treasures Enterprise Ltd [2000] 2 HKC 814. Where the contract is for the provision of services, a payment for part performance may be claimed where the contract is divisible and the services provided constitute the fulfilment of a part; under the doctrine of substantial performance; where complete performance was prevented by the actions of the other party; or where the other party has accepted the part performance.
