释义 | 墊支 A payment which a solicitor in the due discharge of his or her duty is bound to make whether the client furnishes the solicitor with money for the purpose, with money on account, or not: Re Remnant (1849) 11 Beav 603, 50 ER 949. Court fees, ad valorem duty, witnesses’ expenses, and interstate or foreign agents’ fees have each been held to be a disbursement. Counsel’ fees are generally a disbursement (Hindle v Shackleton (1890) 1 Taunt 536), but where counsel was paid directly by the client and did not regard the solicitor as having any liability for payment, counsel’s fees were not regarded as disbursement. Accountants’ fees have been held not to be a disbursement: Weiss v Clayton Utz (1993) 16 Fam LR 929, 114 FLR 159.
