Courts have held that the copying of visual elements and the ‘total concept and feel’ or ‘look and feel’ of a computer program is actionable under copyright law: Whelan Associates Inc v Jaslow Dental Laboratory Inc [1987] FSR 1; Apple Computer Inc v Microsoft Corp (1991) 21 IPR 287. However, the court has held that the ‘look and feel’ concept is a conclusion rather than a means of reaching a conclusion: Lotus Development Corp v Paperback Software International (1990) 18 IPR 1.
