释义 | 確切 A requirement of a valid contract. A contract is void for uncertainty where an important term is left to be settled at a later date or where the language used is so obscure and incapable of definite meaning that the court is unable to attribute to the parties any particular contractual intention: Bank of India v Surtani Murlidhar Parmanand (t/a Ajanta Trading Corp) [1994] 1 HKC 7. If the terms amount to a concluded agreement, it may be possible to save the contract by disregarding the uncertain part on the grounds that it is meaningless: Nicolene Ltd v Simmonds [1953] 1 QB 543; Sun Wah Oil & Cereals Ltd v Gee Tai Trading Co Ltd [1993] 1 HKC 132 (CA).
