| 释义 | 割讓控制權 No longer in one’s control. The control of the acts of an employee at the material time is one of the relevant factors to be considered in deciding the liability of an employer in respect of the acts. When the service of an employee is temporarily put at another’s disposal, it is generally presumed that the employee remains the employee of the original employer and that employer remains liable of the employee’s acts. The extent in controlling of an employee was once held to be the main test in deciding the liability of an employer: Donovan v Laing Wharton & down Construction Syndicate [1983] 1 QB 629.
