释义 | 意圖的確定性 The requirement in the law of trust that there must be certainty of the donor’s intention to create a valid trust: Knight v Knight (1840) 3 Beav 148, 49 ER 58. The intention to create a trust is to be inferred from the words used by the donor. However, there is no need for any technical expression to be used in order to constitute a trust because ‘equity looks to the intent rather than the form’.
