| 释义 | 原來的司法管轄權 Matters in respect of which a proceeding (other than an appeal from a lower court) may be commenced in the Court of First Instance. The civil jurisdiction of the Court of First Instance consists of original jurisdiction and authority of a like nature and extent as that held and exercised by the Chancery, Family and Queen’s Bench Divisions of the High Court of Justice in England; and any other jurisdiction, whether original or appellate jurisdiction, conferred on it by any law: High court Ordinance (Cap 4) s 12(2). The criminal jurisdiction of the Court of First Instance consists of original jurisdiction of a like nature and extent as that held and exercised in criminal matters by the High Court of Justice and the Crown Court in England respectively; and any other jurisdiction, whether original or appellate jurisdiction, conferred on it by any law: s 12(3). The Court of First Instance has the original jurisdiction to election petitions under the Chief Executive Election (Election Petition) Rules (Cap 569E) sch; Legislative Council (Election Petition) Rules (Cap 542F) sch; Village Representative (Election Petition) Rules (Cap 576B) sch. 有關可在原訟法庭展開的法律程序的事宜(來自下級法院的上訴除外)。原訟法庭的民事司法管轄權由以下各方面組成─(a) 與英格蘭高等司法院的大法官法庭、家事法庭及皇座法庭所具有並行使的原訟司法管轄權及權限的性質及範圍相類的原訟司法管轄權及權限；及(b) 任何其他由法律賦予高等法院的司法管轄權，不論是原訟或上訴司法管轄權：《高等法院條例》(第4章) 第12(2)條。原訟法庭的刑事司法管轄權由以下各方面組成─(a) 與分別由英格蘭高等司法院及皇室法庭**就刑事事宜所具有並行使的原訟司法管轄權的性質及範圍相類的原訟司法管轄權；及(b) 任何其他由法律賦予高等法院的司法管轄權，不論是原訟或上訴司法管轄權：第12(3)條。根據《行政長官選舉(選舉呈請)規則》(第569E章)附表；《村代表(選舉呈請)規則》(第576B章) 附表，原訟法庭具有選舉呈請的原本司法管轄權。 |
