释义 | 慣常住所 A term referring to the abode of a person. When it is applied in the context of young children, it was to be decided as a matter of fact by reference to the relevant evidence: D v G [2002] 1 HKLRD 52 (CA). The assumption of habitual residence requires an appreciable period of time and a settled intention: Re N (a child) [2001] 2 HKLRD 377 (CFI). The habitual residence of young children of parents who were living together was the same as the habitual residence of the parents themselves and neither could change it without the consent of the other or an order of the court. When it is applied in the context of married parents living together, to their abode in a particular place or country which they have adopted voluntarily and for settled purposes as part of the regular order of their life for the time being, whether of short or of long duration.
