| 释义 | 疏忽駕駛 Driving without the standard of due care and attention reasonably expected of the ordinary prudent driver. The driver of a motor vehicle on a road, is under a duty to ensure that no danger is caused, or is likely to be a caused by the motor vehicle, and any trailer drawn by it to a road or public and private property; and every vehicle including all body work and fittings and any trailer that is used on the road must be maintained in good and efficient order: Road Traffic (Traffic Control) Regulations (Cap 374G) reg 58(2); Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374A) reg 5. Driving a defective vehicle where the defect might reasonably have been discovered is a negligent act: Lai Por v Tsang Chiu Hon [1983] 2 HKC 359; R v Sunway Gas and Engineering Ltd [1995] 3 HKC 472.
