释义 | 製造疏忽 Failure to ensure that a product which is supplied for use or consumption has not been made defective in the course of manufacture through, for example, contamination (Donoghue v Stevenson [1932] AC 562). A breach of duty of care imposed on manufacturers by the law of negligence. A person who manufactures and sells an article owes a duty to take reasonable care in its design (Lexmead (Basingstoke) Ltd v Lewis [1982] AC 225 (HL)) and manufacture: (Grant v Australian Knitting Mills Ltd [1936] AC 85 (PC)). Persons such as repairers, assemblers, distributors, erectors, architects, local government inspectors, certifiers, installers and persons letting things on hire are qualified under this head and considered to be governed by the neighbourhood principle: Srivastava & Tennekone The Law of Tort in Hong Kong (1995) ch 11 pp 146-147.
