Where the property is let, a mortgagee in possession is entitled to take the rents and profits derived from it: Cockburn v Edwards (1881) 18 Ch D 449. Nevertheless, the rents received are applicable in the first instance in paying the current outgoings, such as rent, taxes, and rates: Conveyancing and Property Ordinance (Cap 219) s 54. Where the mortgage security includes a business carried upon the mortgaged premises, the mortgagee is entitled to carry on the business for a reasonable time with a view to sale. However, the mortgagee may be liable to the mortgagor if he fails to carry out his duties properly: Standard Chartered Bank v Grow Up Trading Ltd [1999] 3 HKC 530. The mortgagee would also be liable for any new contracts into which he enters: Burt, Boulton and Hayward v Bull [1895] 1 QB 276. In addition, a mortgagee in possession would be accountable to the mortgagor for rents and profits he received or should have received if not for the neglect or default of the mortgagee, and is liable to execute repairs on the mortgaged premises.
